Criminal mandate

Municipal Police officers are entitled to impose fines for certain types of offenses. In accordance with the provisions of the Code of Conduct in Cases for offenses, the person punished with a fine has the right to refuse to accept it. The penalty imposed by the city guard becomes legally binding upon receipt of its receipt by the punished person.

A validly imposed penalty may not be revoked, unless a fine was imposed for an act which is not a criminal offense. In such case, the waiver takes place at the request of the punished person submitted within 7 days from the date of the mandate becoming final or ex officio. The authority competent to hear such a case is only the court (District Court) in whose area the fine was imposed.

If the right to refuse to accept a penalty notice is exercised, an application for punishment is sent to the Court against the perpetrator.

In the light of the applicable regulations, the Commander of the City Guard does not have the power to cancel the imposed penalty notice.

If the person fined with the fine is not registered in the territory of the Republic of Poland, a cash fine is imposed, which must be paid directly to the guard who imposed the fine.
